Generally once in a life time everyone of us has to give a visit at sub registrar office for registering a legal document that may be a Sale Deed, Sale Agreement, Loan Agreement, Lease Deed  etc. for this we submit our identity proofs which we carry at the time of registration.
All of us have various kinds of documents like PAN Card, Aadhar Card, Driving licence, Passport, Academic Certificates, Investment Documents (Like Share Certificate, bonds etc.), Shop Act License, property documents like Sale Deed, Khata Certificate etc. what if we lost or misplace or somebody stole it from us, it will affect our daily routine work, and compel us to suffer from monetary as well as non monetary losses and this This happens with everybody which is now usually become common at all areas.   

But, What if you misplace an important property documents like Sale Deed of your property and never found it..? We all know how very important sale deed is... A sale deed has almost all the details required to carry out the purchase or sale of the property which is generally useful to mortgage the property for loan requirement.  Most importantly the sale deed would require the owner to certify that the property under sale is free from any encumbrance and without any lien.

So, If it is lost or misplaced then without it, it is a daunting task to sell/ buy a property and it is also very difficult task to take a home loan on such property.

There are few instances even bank or financial institutions have misplaced the original documents of the property.

So in this article, I will going to make you aware regarding the procedure one should undertake to recover or to safeguard him/her self from the misuse of the document. So lets discuss following:-

1. How to obtain certified copy of the lost property documents like Sale Deed ?

HOW TO OBTAIN CERTIFIED COPY OF LOST SALE DEED  ..?

Losing sensitive and valuable document like a sale deed can happen to anyone. So what is the procedure to obtain a copy of lost Sale Deed.? Below is the check list of what you have to do (owner of the property) in case if you have misplaced the original property documents:

It is very common for any act of theft, robbery of valuable, important things or even missing things everyone has to knock the door of police station to lodge the complaint it may be in the form of NC or it may be an FIR. In normal scenario police authorities only issue NC's u/s 155 of the Indian Penal Code and give excuses for not registering the FIR. The burden of the same is on the Owner whether he needs FIR or NC of the complaint is sufficient for him. Therefore, following is the first step everyone has already known to it.


1. File a Police Complaint Immediately:-   
  • The first thing you need to do is to file FIR (First information report)in the nearest police station where you have lost your property documents.
  • Kindly note that only owner of the property has to file an FIR, stating that the property papers have been mis-placed or lost or stolen. Do give your mobile number when registering the FIR so that you can track its status later online.
  • You are advised to save or keep the copy of the FIR for future use. Becuase the prospective buyers of your property or bankers may ask it in the future.
  • Kindly note that the Supreme Court has recently ordered all States and union Territories, Police Department to upload First Information Reports (FIR's) on police or government websites within 24 ours of their registration in police station. you can view the FIR details and its status online; For Example below is the screen print of Tamilnadu  Police Department Portal home Page. 2. Apply for certified copy of Sale Deed:-

  • After lodging your complaint at nearest police station, you have to visit the sub-registrar office where the property is registered and have to make an application to get a certified copy of Sale Deed.
  • The registration office has the scanned copy of your sale deed with them but they will not give a certified copy immediately.
  • They will ask you to publish an advertisement in national and regional (local) news paper about the loss of property documents (Sale Deed).

3. Place an Advertisement:-
  • You have to publish a 'Lost & Found' advertisement in both national and local news paper, clearly mentioning the details of the lost documnt and your contact details.
  • It is a statutory requirement to publish an Ad.in certain cases, you may have to produce an Affidavit or FIR to the news paper agency before placing Lost and Found Advertisement.

  • Remember to keep a copy of the complaint as well as press cuttings as a proof pf loss. 
  • After publishing Ads., you may have to wait for 2 to 4 weeks to see if anyone finds your property documents and returns them within stipulated time that you have mentioned in Ad. 
4. Prepare an Affidavit and get it notarized:-

   Even after waiting for say 10 to 15 days, if you do not find the lost documents, you can get an Affidavit prepared on Stamp Paper. you have to clearly state the details of the lost sale deed and other documents and sign the undertaking. you can attache the police FIR and copies of the newspaper Ads to this Affidavit.The undertaking needs to be attested and registered with a public notary.

5. Get the duplicate sale deed from SRO:-

You have to pay prescribed fee meant for this purpose at SRO. Enclose the police FIR Document, Ads, Affidavit along with the Application for certified copy of Sale Deed. The Staff at SRO will verify this documents and issue you a legally certified duplicate copy of Sale Deed. Thereafter, certified copies of Title Deed are used as substitute for the Original. 

6. FAQ's on Property Documents lost / misplaced:-

 Below are the some FAQ on this topic:-

A. I have taken home loan and my bank have misplaced the Original Sale Deed, What is the procedure to get a duplicate Sale Deed..?

Answer:-
  • Submit a written complaint to the bank and keep a copy of their reply with you.
  • Register an FIR with a Police against Bank.
  • Publish News paper Ad.
  • Get the Affidavit done by the bank about the lost property documents.
  • Do apply for encumbrance certificate to check if everything is fine with respect to ownership and mortgage details.
  • Get duplicate copy of Sale Deed through you banker/ finance lending institution.
  • You can ask the bank to bear all the associated costs.
B. Can I buy property without Original Sale Deed ? 

Answer:- 
  • If the deal is good and you do not want to miss buying such property. You can ask for the certified copy of sale deed. Police FIR Document, Copies of Ads published in Newspaper etc. from Seller/ Owner of the Property. Do take the latest search or title reports to know the encumbrances on property. Kindly take legal opinion and help from Civil Lawyer  before taking final decision.
C. Can I get a home loan if original sale deed is missing:- 

ANSWER:-

Certified copy of sale deed cant replace the original sale deed when it comes to raising loan over such property, Banks may ask for the Police FIR,certified copy of sale deed, affidavit etc., before issuing home loan.


D. My property is in Society or maintained by Association, do I need to inform them about the loss of property documents? 

ANSWER:-

Yes, you have to inform them and also need to get NOC (No Objection Certificate ) from them.

E. Can any one non owner apply for a copy of sale deed..?

ANSWER:-


  • There are conflicting views on this. i believe as the documents registered at SRO comes under Public domain (except Wills), so anyone can make an application for copy of sale deed at concerned SRO. However, you may not get a certified copy
  • You have to give details like owners name, document number, property schedule info etc., to get copy of sale deed.
  • Some states do provide Sale Deed details online (not a copy of sale deed but only details of registration).
  • Some sub-registrars may issue copy of Sale deeds to the owners of the respective properties only, in such a case you may have to file an RTI application and get the required details.

A sale deed is one of the most valuable legal document in the purchase or sale of the property. you might have genuinely lost or misplaced the property documents. but don't take this lightly kindly file FIR immediately. Apply for the certified copy of Sale Deed at an earliest. Be prepared to spend your time as well as good amount of money to get this done.

                                       AN OVERVIEW ON FLAT PURCHASES (INDIA).


Purchasing property of your own can be a tedious task. The consistently appreciating property rates, the complexities of laws and the tedious procedures can certainly put someone off the idea of purchasing a flat or an apartment of their own. In this article I am Adv. Sharvari Shinde will try to simplify the process or at-least attempt to decipher the complexities involved. Given below is a step to step guide which you may refer while purchasing a flat.   


STEP ONE:- A BACKGROUND CHECK

The golden rule here is 'never blindly rely on what the builder/ his sales representative represents. It is the right of the buyer to have a complete information about the property he/she is going to purchase. A thorough background check of the property is a must before finalising the purchase of the flat. The following pointers are to be remembered while conducting the background check: 

(a) Title of the Property:-

By this we mean, the history of the land on which the buildings is constructed or being constructed. The buyer has to ascertain who was the previous owner, has the previous owner lawfully transferred the property to the builder/ developer and does any other person have any right on the property which will affect the buyers right to the flat. For this the buyer can ask the builder for an inspection of all the documents of the property. While conducting the inspection, the buyer should arrange the documents chronologically and check if each and every document is registered. Do not rush this step and do not afraid to ask questions. The builder should know the history of the property and he should give you an inspection of all registered original documents. The following documents have to be checked: 

(i) Deed of Conveyance :-

A document recording that the land has been lawfully transferred to the builder. It must be registered. 

(ii) NOC of the previous owners :- 

The previous owners giving their 'no objection' to any construction activity conducted by the builder.

(iii) Property Card or 7/12 Extract :-   

This is a record of the government which shows who is the present (lawful) owner of the property and it also shows the history of the land, its previous owners, the modes of sale etc. It is an essential document and must be checked by the buyer.

(iv) Title Certificate of a Solicitor :- 

It is a certificate issued by a solicitor which says that the builders is the lawful owner of the land and the land is free of all encumbrances (encumbrance = burdens/obstructions/inconveniences).

STEP TWO: APPROVALS: 


Once the buyer is satisfied that the background of the property is clear, the buyer should ensure that the builder has all the approvals of the municipal corporation to construct on the property. Once again it is the right of the buyer to demand an inspection of all original certificates/ approvals obtained by the builder. These approvals can have really confusing names, so they are explained as below: 

(a) Approved Plans:   

Once the builders architect draws the structure of the building (including the flat) the same have to be approved by the local municipal corporation. The corporation will ensure that the foundation of the building is strong, the construction is environmentally safe, has the builder abided with all the safety standards prescribed etc. Once the corporation is satisfied that the building plans are viable, the same are approved by stamping the same. The builder has to construct exactly as per the plans and any deviation from the same has to be approved. 

(b) IOD (Intimation of disapproval):  

In short this is a 'green signal' for builders for the corporation. An IOD presents a list of approvals which the builder has to obtain after which he can start constructing the building. An IOD is accompanied with the approved building plans. The builder has to obtain all the approvals as mentioned in the IOD in order to start construction of the building. Sometimes IOD is only for a part of the building and sometime it is for the entire structure. 
The buyer here has to ensure that the all the permissions as mentioned in the IOD are obtained and the builder has obtained the entire IOD or not. It is always advisable to purchase a flat only after the IOD for the particular floor of the building is obtained by the builder.  

(c) CC (Commencement Certificate) : 

What follows an IOD is a CC. after the builder obtains all the permissions, and NOC's as mentioned in the IOD, he applies to the corporation to get a certificate stating that he can commence construction on site. This certificate called the CC. usually a part CC is granted initially which is only for the plinth of the project i.e. for the basement or ground floor of the project, after which it is extended floor wise. 

(d) OC (Occupation Certificate): 

Once the building is constructed, the corporation inspects it and certifies that the same is fit to be occupied and connected to all the utilities like electricity connection, water connection etc.

(e) Completion Certificate:

This is the final certificate given by the corporation after inspection which shows that the entire building is completed, and the flats are ready with all utilities. 

The safest phase to purchase  a flat is when the commencement certificate is obtained for the flat which the buyer wants or when the OC or the completion certificate is obtained. 

STEP THREE: THE COST FACTOR  

The cost of your flat will depend on the area of your flat and the common area which you will use. The area of your flat will be described either in the following terms. 

Built-up-area:-
The area of the flat including the thickness of the wall.

Saleable Area:-
The area of the flat minus the area occupied by the walls. It is the area which you will actually use. 

The common area of the floor: 
It is the spaces which all the occupants of a single floor will share i.e. staircase area, lift and lobby space. While fixing the cost for this common area, flats with a higher salable area, contribute in a higher proportion towards the common area on the floor.

The common area of the building:
These areas are equally enjoyed by all occupants and hence all the purchasers pay equally for these areas. These areas include your main lobby space, electricity room, pump room etc. 

The super built-up area:  
It is the total of built up area + common area on the floor + common area of the building.

The parking space:
Generally every flat is allotted with at least one free parking space. If the buyer needs more than one space for parking, he can purchase the same from the builder. 


The cost of the flat will be based on the super build up area of the flat and if the buyer is interested in purchasing additional parking space, the same will be added to the cost of flat. 

STEP FOUR: THE TAX FACTOR 

As per the current taxation laws, the buyer has to pay the stamp duty on the purchase of the flat which varies anywhere between 6% to 12% of the flat cost and he also has to pay the stamp duty for the flat, which will be decided by the current stamp duty rules. These charges will increase the sale price of the flat but it is always advisable to pay them and get the sale registered in order to avoid any misuse by the builder. 


STEP FIVE: THE PURCHASE


This is the final stage of the flat purchase where the buyer and builder will sign agreements for purchase of the flat. The agreements are usually called       "Agreement for sale" or a " Sale Deed". The builder will present to the buyer a standard format agreement which he has prepared for all the buyers, but the buyer can change the clauses if he finds them too restrictive or if he is not happy with them. It is always important to include the entire price of the flat (including the tax liabilities), the proper area and description of the flat, the description of the common areas and parking spaces enjoyed and the date on which the buyer will be given the occupation of the flat by the builder. Once the buyer is satisfied with all the clauses of the agreement, the same can be signed and registered, in the office of the registrar of Assurances which is located at various locations in district. 

The signing of the agreement and its registration completes the flat sale process. 

STEP SIX: THE POSSESSION LETTER


The Possession Letter is given by the builder to buyer after completing all the formalities of execution and registration of agreements/documents w.r.t. sale of flat to the buyer. The letter consist, the flat is ready for possession with all utilities and it is conveyed to the buyer.  

It is indeed a long drawn process to purchase a flat, however, with enough patience and awareness about the procedures, it can be ensured that the buyer will be able to purchase his/her dream home/house without major glitches.

कायद्याचे शिक्षण घेवू इच्छी नाऱ्यानसाठी कायदा आणि त्याच्या पदवीचे महत्व आणि त्यात उपलब्ध असलेल्या विविध संधींबाबत आजचा हा लेख :


वकिली व्यवसायात कित्येक नवीन क्षेत्रे विकसित होत आहेत. या क्षेत्रात आगेकूच करण्यासाठी आवश्यक ठरणारी कौशल्ये, अभ्यासक्रम याबाबतचे मार्गदर्शन फार जुनी परंपरा असलेल्या करिअरच्या पर्यायाची आज नव्याने ओळख करून घेऊ या आणि तो म्हणजे कायदे शिक्षणातील करिअर संधीचा. 'अम्ब्रोस बीअर्स' या लेखकाने त्याच्या 'डेव्हिल्स डिक्शनरी' या उपरोधिक लेखनात वकिली व्यवसायाचे वर्णन करताना असे लिहिले आहे की,  "Lawyer is someone who is skilled in the 'circumvention of the law'". अगदी खरं आहे, आपल्या देशातसुद्धा कायद्यातून पळवाटा शोधून काढण्याइतकी कायद्याची समज ज्याला आहे, अशा वकिलाला भलतीच मागणी असते. अर्थात, त्यासाठी त्याचे ज्ञान सखोल असणे गरजेचे आहे, हे सत्य आपण नाकारू शकत नाही. आजपर्यंत होऊन गेलेले अनेक प्रसिद्ध लेखक, राजकारणी, स्वातन्त्र्यसेनानी हे वकील होते. महात्मा गांधी, डॉ. राजेन्द्र प्रसाद, फ्रान्झ काफ्का, अब्राहम लिंकन ही सर्व सन्मान्य व्यक्तिमत्त्वे वकीलच होती.


एकंदरीतच आपल्याकडील कायद्यांचे स्वरूप फार क्लिष्ट असल्याने वकील आणि न्यायाधीशांचे न्यायव्यवस्थेतील स्थान महत्त्वपूर्ण आहे. आपल्या देशात फार पूर्वीपासूनच वकिली (कायदेशास्त्र) हा पेशा लोकप्रिय आहे. सामान्यत: ज्या कुटुंबांतून पिढय़ान्पिढय़ा वकिली व्यवसाय चालत आला आहे, अशा घरांतील विद्यार्थ्यांचा कल वकिली शिक्षणाकडे अधिक असतो. अर्थात वकील होण्यासाठी अशा प्रकारच्या कौटुंबिक पाश्र्वभूमीची किंवा वकिलीचा वारसा असण्याची मुळीच गरज नाही. जर मनापासून आवड असेल तर कोणीही व्यक्ती कायद्याचे शिक्षण घेऊ शकते.

बदलत्या काळाबरोबर समान नागरी हक्क व त्यातील कायदे यांबाबत जागृत होत आहे, आणि साहजिकच कायदा क्षेत्रातील रोजगार संधींची व्याप्ती आणि लोकप्रियताही वाढत आहे. थोडक्यात सांगायचं झालं तर वकील म्हणजे वकिलीचा व्यवसाय स्वीकारत अशिलांना कायदेशीर सल्ला देण्यासाठी सरकारने अधिकृत केलेली व्यक्ती. वकील असलेल्या व्यक्तींना कायद्याचा समर्थपणे आधार घेत, आपल्या अशिलांचे प्रतिनिधित्व करण्याची व त्यांचा कायदे सल्लागार होण्याची दुहेरी जबाबदारी पार पाडायची असते. कायद्याचा अधिवक्ता (अ‍ॅडव्होकेट) या नात्याने वकिलांना फिर्यादी किंवा प्रतिवादी अशिलाच्या वतीने न्यायालयात तोंडी युक्तीवादाद्वारे किंवा प्रस्ताव, टिपणे अशा लेखी कागदपत्रांद्वारे खटला चालवण्याचे काम करावे लागते, तर सल्लागार म्हणून खटल्यातील घटना कायद्याच्या चौकटीत बसवण्याबाबत अशिलांशी सल्ला-मसलतही करावी लागते.

अनुभवी वकिलांचे वेतन अनेक गोष्टींवर अवलंबून असते. उदा. कामाचे ठिकाण, संस्थेची किंवा कंपनीची क्षमता, सदर संस्थेत कोणत्या प्रकारची कामे केली जातात वगरे. सरकारी खात्यात काम करणाऱ्या पदवीप्राप्त वकिलाला सरकारी नियमांप्रमाणेच वेतन मिळते.  स्वतंत्रपणे वकील किंवा कायदे सल्लागार म्हणून व्यवसाय करणाऱ्या व्यक्तीची आमदनी त्याच्याकडे येणाऱ्या अशील, ग्राहक यांच्या संख्येवर व त्यांच्या सांपत्तिक स्थितीवर अवलंबून असते. कोर्टात वकिली सुरू करणाऱ्या वकिलांना पाच हजार ते ४० हजारांपर्यंत विद्यावेतन (स्टायपेंड) मिळू शकते. अर्थात हा आकडा ते कोणत्या ज्येष्ठ वकिलाच्या हाताखाली काम करत आहेत, यावर अवलंबून असतो. या क्षेत्रातील उत्तम मिळकत देणारा व्यवसाय म्हणजे लीगल प्रोसेस आउटसोìसग. असे काम करणाऱ्या कायद्यातील पदवीधराची प्राप्ती २० हजार ते ५० हजार असू शकते.

कायद्यातील पदवीधरांसाठी अमाप संधी उपलब्ध आहेत. एकतर कोर्टात वकिली करणे किंवा कॉर्पोरेट फर्ममध्ये काम करणे, नाहीतर पब्लिक सíव्हस कमिशनच्या परीक्षांद्वारा न्यायाधीश म्हणून रूजू होणे. पुरेसा अनुभव घेतल्यानंतर कायद्यातील पदवीधर, सरकारी, मंत्रालयीन विभागांतून सॉलिसिटर जनरल अथवा पब्लिक प्रोसिक्युटर या पदांवरून आपल्या ज्ञानाचा व अनुभवाचा वापर सरकारी सेवेत करू शकतात. शिवाय वेगवेगळ्या आस्थापानांतून कायदेविषयक सल्लागार, महाविद्यालयांतून प्राध्यापक, स्वयंसेवी संस्था किंवा दूरचित्रवाणी वाहिन्या, वृत्तपत्रे अशी प्रसारमाध्यमे असे नानाविध पर्याय खुले आहेतच.




योग्य, पात्र वकिलांची कमतरता ही नेहमीच भारताच्या न्यायव्यवस्थेपुढील मोठी अडचण राहिली आहे. कायद्याचे पदवीधर असलेले तरुण होतकरू युवक-युवती सदस्य होत नसल्याची खंत बार कौन्सिलने वारंवार व्यक्त केली आहे. कायदेतज्ज्ञांची आकडेवारी असं सांगते की, देशातील जवळपास १० लाख वकिलांपकी फक्त २० टक्केच कोर्टात वकिली करण्यायोग्य आहेत. म्हणूनच देशातील कायदे शिक्षणाचा स्तर उंचावण्यासाठी आणि कुशल वकील घडवण्यासाठी, कायदे शिक्षण देणाऱ्या संस्थांची स्थापना झाली.

कोर्ट-कज्जे आणि खटल्यांच्या संख्येत आपला देश सर्वात वरच्या क्रमांकावर असल्याने वकिली पेशाला आपल्याकडे नेहमीच बरकत राहणार, हे नक्की. ब्रिटिश वकील आणि शिक्षणतज्ज्ञ सर आयवोर जेन्निन्ग्स यांनी भारतीय संविधानाचा उल्लेख 'वकिलांसाठी स्वर्ग' असा केला आहे. थोडक्यात काय, प्रतिभावान वकिलाला मिळकतीची चिंता नाही.

वकिली व्यवसायात टिकून राहण्यासाठी प्रचंड संयमाची आणि तर्कसुसंगत कौशल्याची गरज असते. या पेशात यशस्वी व्हायचे असेल तर निष्ठापूर्वक आणि अविश्रांत मेहनतीशिवाय दुसरा पर्याय नाही. वकिलीची कोणतीच पाश्र्वभूमी किंवा पूर्वानुभव नसताना या व्यवसायात उतरणाऱ्या व्यक्तींना साहजिकच अनेक अडचणींना तोंड द्यावे लागते. करिअरच्या सुरवातीला जर एखाद्या ज्येष्ठ मार्गदर्शकाच्या हाताखाली काम करण्याची संधी मिळाली तर मार्ग थोडा सुकर होतो, इतकेच. याचा अर्थ नवशिक्या उमेदवारांनी हार मानण्याची मुळीच गरज नाही, कारण तीव्र मनोनिर्धार आणि प्रयत्नांची जोड असेल तर कोणतीच गोष्ट अशक्य नसते. याव्यतिरिक्त वकील होण्यासाठी उत्तम संवाद कौशल्य, विश्लेषणासाठी आवश्यक ठरणारे उपजत ज्ञान, हजरजबाबीपणा, प्रसंगावधान या अंगभूत गुणांची आवश्यकता असते.

तीन वर्षांचा एलएल.बी. शिक्षणक्रम पूर्ण करण्यासाठी तीनही वष्रे मिळून साधारणपणे २० ते ३० हजार रु. इतका खर्च येतो. पण पाच वर्षांच्या बी.ए.-एलएल.बी. अभ्यासक्रमासाठी मात्र सुमारे तीन लाख एवढा खर्च येतो. साहजिकच हा पर्याय तुलनेने खर्चीक वाटतो, शिवाय वसतिगृहाच्या खर्चात शिक्षणक्रमाचे शुल्क अंतर्भूत नसते.

भारतातील कायदेविषयक व्यवसायाची व्याप्ती वाढवण्याच्या हेतूने आणि परदेशी कायदे कंपन्यांना भारतात व्यवसाय सुरू करता यावा या दृष्टीने प्रयत्न सुरू आहेत. हे शक्य झाल्यास कायद्यातील पदवीधरांना परदेशी लॉ फम्र्समध्येही नोकरीच्या संधी उपलब्ध होतील. लीगल प्रोसेसेस आऊटसोìसग व्यावसायिकांनी अमेरिकी कायदे, इंग्लंडचे कायदे या संदर्भातील कामांसाठी कायद्यातील पदवीधारकांची नेमणूक सुरू केली आहे. कायदे शिक्षणाची व्यापकता वाढल्याने त्यांतील कमी अवधीचे अभ्यासक्रम करण्याकडे अन्य व्यावसायिकांचा कल वाढत आहे. यामुळे एकूणच कायदेविषयक जागृती वाढण्यास मदत होईल, हे मात्र नक्की.

भारत आणि इंग्लंडमधील कायदेविषयक शिक्षणात बरेच साम्य आहे. तसेच इंग्लंडमधील बरीच विद्यापीठे भारतीय विद्यार्थ्यांना कायदे शिक्षण घेण्याची संधी देऊ करतात. इंग्लंडमध्ये कामाचा मोबदला उत्तम मिळत असल्याने भारतीय विद्यार्थ्यांनाही इंग्लंडमध्ये काम करण्यात विशेष रस असतो. आजकाल भारतीय विद्यार्थी अमेरिकेतील महाविद्यालयांतून कायद्याचे शिक्षण घेतात आणि अभ्यासक्रम पूर्ण होताच अमेरिकेतच लठ्ठ पगाराच्या नोकऱ्याही मिळवतात. परदेशांत कायदे शिक्षण घेऊ पाहणाऱ्या भारतीय विद्यार्थ्यांसमोर आज हार्वर्ड लॉ स्कूल, येल युनिव्हर्सटिी, ऑस्ट्रेलिया नॅशनल युनिव्हर्सटिी असे आकर्षक पर्याय उपलब्ध आहेत.





डॉक्टर्स किंवा चार्टर्ड अकौंटन्ट्सप्रमाणे वकिलांनाही स्वत:च्या क्षेत्रात पारंगत होण्यासाठी व अशिलांमध्ये लोकप्रिय होण्यासाठी भरपूर अनुभवाची गरज असते. त्यांच्या वकिली ज्ञानाची परिणामकारकता दिसून येण्यासाठी पुरेसा काळ जावा लागतो. म्हणूनच वकिली पेशात यशस्वी होण्याचा निर्धार केलेल्या होतकरू वकिलांनी व्यवसायाच्या सुरुवातीच्या काळात संयम, धीर बाळगणे जरुरीचे आहे. अर्थात वकिलीचा जम बसल्यानंतर मात्र मिळणाऱ्या यश, सत्ता, पसा या कशालाच मर्यादा नसतात, हेही तितकेच खरे.

नॅशनल लॉ स्कूल ऑफ इंडिया युनिव्हर्सटि (NLSIU) बंगलोर किंवा नालसार, हैदराबाद अशा सर्वोत्तम कायदे शिक्षण देणाऱ्या महाविद्यालयांतून, पाच वर्षांचा बी.ए.एलएल.बी. शिक्षणक्रम पूर्ण करणाऱ्या विद्यार्थ्यांना लॉ फम्र्स आणि आय.टी.ई.एस. (इम्फॉर्मेशन टेक्नोलॉजी अँड एनेबल्ड सर्व्हिसेस) फम्र्समधून नोकरीच्या आकर्षक संधी उपलब्ध होतात. बरेच जण स्वत:चा कायदेविषयक व्यवसाय करण्याचा पर्याय स्वीकारतात. कोर्टात वकिली करू इच्छिणाऱ्या कायद्याच्या पदवीधर व्यक्तीला ज्येष्ठ वकिलांच्या हाताखाली काम करावे लागते आणि बार कौन्सिल ऑफ इंडियात स्वत:ची नोंदणी करून घेणे आवश्यक असते.

लॉ फम्र्स किंवा ज्येष्ठ वकिलांकडे काम करण्याची संधी मिळवण्यासाठी कोर्टातील कामाचा प्रत्यक्षदर्शी अनुभव कामास येतो. खरंतर बहुतांश लॉ कॉलेजेस, शेवटच्या वर्षांत कायद्याचे प्रत्यक्ष ज्ञान विद्यार्थ्यांना देतच असतात, तरीही विद्यार्थ्यांनी आपणहून वरचेवर कोर्टात जाऊन न्यायालयातील दैनंदिन कारभार समजून घेतला पाहिजे.    
करिअरच्या संधी खासगी तसेच सरकारी आस्थापानांतून वकिली शिक्षण घेतलेल्या व्यक्तींना नोकरीच्या संधी उपलब्ध होतात. पण बरेचसे वकील रीतसर वकिलीच्या व्यवसायाकडेच वळतात. यासाठी मात्र स्थानिक/ राज्य/ केंद्रीय बार कौन्सिल चा नोंदणीकृत सदस्य होणे क्रमप्राप्त असते. केंद्र व राज्य सरकारी नोकऱ्यांचा पर्यायही कायदे शिक्षण घेतलेल्या व्यक्ती स्वीकारू शकतात.

वेगवेगळ्या न्यायालयांतून न्यायाधीश, मुखत्यार वकील (अ‍ॅटर्नी), सॉलिसिटर, सरकारी वकील तसेच देशाच्या संरक्षण मंत्रालय, कर वसुली विभाग (टॅक्स डिपार्टमेंट), कामगार कल्याण विभाग (लेबर डिपार्टमेंट) अशा क्षेत्रांमध्येही त्यांची नेमणूक होऊ शकते. इतकेच नाही तर कायदेसल्लागार किंवा कायदेविषयक मार्गदर्शक म्हणून खासगी कंपन्या, संस्था, कौटुंबिक वाद, कलह या क्षेत्रांतही वकील व्यक्तींची गरज भासते.

खासगी संस्थांतून कंपनी सेक्रेटरी म्हणूनही ते काम करू शकतात. टॅक्स लॉज, पेटंट लॉज, एक्साइज लॉज, इन्व्हायम्रेन्टल लॉज, लेबर लॉज या संबंधात मार्गदर्शन करणाऱ्या संस्थांतून (कन्सल्टन्सी फर्म) कायदेशिक्षित व्यक्ती काम करू शकतात. त्याचबरोबर निरनिराळ्या ट्रस्टचे (न्यास) विश्वस्त, प्रसारमाध्यमांतून पत्रकार, कायद्याचे शिक्षण देणारी महाविद्यालये व शैक्षणिक संस्थांमधून शिक्षक किंवा प्राध्यापक म्हणूनही कायदेशिक्षण घेतलेल्यांना भरपूर वाव मिळतो.   

स्वयंसेवी संस्थांना (एन.जी.ओ.) वकिली सेवेची गरज भासते. तसेच आंतरराष्ट्रीय पातळीवर युनो, इलो (इंटरनॅशनल लेबर ऑर्गनायझेशन) इसिजे (इंटरनॅशनल कोर्ट ऑफ जस्टिस) यांतून नामांकित, यशस्वी वकिलांची नेमणूक होऊ शकते.
कायदेविषयक व्यवसाय करण्यासाठी..
कायदे क्षेत्रात करिअर करू इच्छिणारे विद्यार्थी कोणत्याही शाखेतील पदवी घेतल्यानंतर तीन वर्षांचा कायदेविषयक अभ्यासक्रम (एलएल.बी) किंवा बारावी उत्तीर्ण होऊन पाच वर्षांचा कायदा अभ्यासक्रम करू शकतात. खरंतर तीन वर्षांऐवजी पाच वर्षांचा अभ्यासक्रम करणे केव्हाही चांगले. बहुतेक वेळा महाविद्यालयांतून तीन वर्षांचा डिग्री लॉ कोर्स उपलब्ध असतो. अन्य विद्याशाखांतून पदवी घेतलेल्या, पण एलएल.बी करू इच्छिणाऱ्या विद्यार्थ्यांसाठी तो चालवला जातो. परंतु वकिली व्यवसाय किंवा कायदेविषयक अन्य कोणताही व्यवसाय करू पाहणाऱ्या विद्यार्थ्यांनी पाच वर्षांचा कायदे प्रशिक्षणक्रम स्वीकारणे उत्तम.

एलएल.बी. कोर्स बार कौन्सिलद्वारा नियंत्रित केला जातो. देशांतर्गत वकिली करण्यासाठीच्या अटी व नियम, बार कौन्सिलकडूनच ठरवले जातात. कायदेविषयक विशेष उच्च शिक्षण मास्टर्स, एमफील, पीएचडी या स्तरावर घेता येते. अशा उच्च शिक्षणाचा उपयोग विद्यार्थ्यांना शैक्षणिक क्षेत्रांत नोकरी मिळवण्यासाठी होतो. आजकाल फक्त सिव्हिल/ क्रिमिनल शाखांतील कायदे शिक्षणाला प्राधान्यक्रम न देता विद्यार्थी कायद्याच्या इतर अनेक शाखांचे शिक्षण घेऊ शकतात. उदा. पेटंट लॉ, कॉर्पोरेट लॉ वगरे. कारण कायद्यातील पदवीचा उपयोग केवळ वकिली करण्यासाठीच होतो असे नाही, तर या शिक्षणाद्वारे खासगी व्यवस्थापन, प्रशासकीय सेवा, कायदेविषयक सेवा अशा अनेक क्षेत्रांत व्यवसायाचे, रोजगाराचे अनेक पर्याय उपलब्ध होतात.




पाच वर्षांच्या बी.ए.एलएल.बी. प्रवेशासाठी पूर्ण देशपातळीवर प्रवेश परीक्षा घेतली जाते. द नॅशनल लॉ एन्ट्रन्स एक्झाम, कम्बाइन्ड लॉ अ‍ॅडमिशन टेस्ट- एलएटी या परीक्षांच्या  माध्यमातून विद्यार्थ्यांचे इंग्लिश भाषेचे सामान्य ज्ञान (जनरल इंग्लिश), कायदेविषयक स्वाभाविक ज्ञान (लीगल अ‍ॅप्टिटय़ूड), सामान्य ज्ञान (जनरल अवेअरनेस), ताíकक कौशल्य (लॉजिकल स्किल) यांची चाचपणी होते. वास्तविक पाहता इच्छुक उमेदवारांनी सीनिअर सेकंडरी एक्झाम संपताच या प्रवेश परीक्षेचा अभ्यास सुरू करायला हवा. काही विद्यापीठांतून तीन वर्षांच्या एलएल.बी. कोर्सच्या प्रवेशासाठीही प्रवेश परीक्षा अनिवार्य असते, त्यासाठीचा अभ्यासक्रमही साधारण असाच असतो.
वकिली व्यवसाय करण्यासाठी एक वर्षांच्या प्रत्यक्ष कामाचा (इंटर्नशिप) अनुभव अनिवार्य आहे. ही अट कायदे शिक्षण प्रशिक्षणाच्या शेवटच्या वर्षांतही पूर्ण करता येते. बऱ्याच शैक्षणिक संस्था व विद्यापीठांतून एलएल.बी पदवी प्रशिक्षणक्रमासोबतच कायद्याच्या विविध शाखांतील पदव्युत्तर शिक्षणाचीही सोय आहे. याअंतर्गत पी.जी. प्रोग्राम्स इन लॉ (एलएल.एम.), कायद्याच्या विविध शाखांतील पदव्युत्तर पदविका कोस्रेसचा समावेश होतो. याचा कालावधी दोन वर्षांचा असून इच्छुक विद्यार्थी एलएल.बी पदवीधर असणे गरजेचे आहे.




कायद्यांची विभागणी काही विशेष शाखांमध्ये होते. उदा. सिव्हिल लॉ, क्रिमिनल लॉ, कॉर्पोरेट लॉ, इन्कम टॅक्स लॉ, इंटरनॅशनल लॉ, लेबर लॉ, कॉन्स्टिटय़ूशनल लॉ, पेटंट लॉ वगरे.
कायदे शिक्षणाच्या आणि व्यवसायाच्या विविध शाखा कायदे शिक्षणाच्या विविध शाखांप्रमाणे त्यांतील वकिली व्यवसायाच्याही वेगवेगळ्या शाखा आहेत.
* (क्रिमिनल लॉयर) फौजदारी वकील-  या प्रकारच्या वकिलांना फौजदारी कायदे, त्यातील कायदे प्रक्रिया, क्रिमिनल प्रोसिजर कोड, इंडियन पीनल कोड, एव्हिडन्स अ‍ॅक्ट आणि अन्य दंड विधाने (पीनल लॉज) याबाबत सखोल ज्ञान असते.

* (सिव्हिल लिटिगेशन लॉयर)- दिवाणी खटल्याचे वकील- असे वकील दिवाणी कायदे (सिव्हिल लॉ) उदा. कर निर्धारण कायदे (टॅक्सेशन लॉज), अबकारी कर कायदे (एक्साइज लॉज) यांत तज्ज्ञ असतात.

* (लीगल अ‍ॅनलिस्ट) कायदे विश्लेषक- या व्यक्ती कंपन्या किंवा लॉ फम्र्समध्ये काम करतात आणि त्या कंपनीच्या कामकाजासंदर्भात लागू होणाऱ्या कायद्यांचे विश्लेषण करतात.

* डॉक्युमेंट ड्राफ्टिंग लॉयर- या प्रकारचे वकील तरतऱ्हेच्या खटल्यांसाठी लागणारे करारनामे (अ‍ॅग्रीमेंट), खटल्यांसंबंधातील आवश्यक कागदपत्रांची, अटी व शर्तीची पूर्तता यामध्ये तरबेज असतात.

* (लीगल जर्नलिस्ट) विधी पत्रकार - या प्रकारचे पत्रकार गुन्हेविषयक बातम्या, न्यायालये, लवादी न्यायालये (अरबीट्रेशन कोर्ट), आंतरराष्ट्रीय न्यायालये आणि लवादी घटना (अर्बीट्रेशन इव्हेन्ट) यांतील न्यायालयीन कार्यवाहीचा वृत्तान्त प्रसारमाध्यमांपर्यंत पोहोचवतात.

* (लीगल अ‍ॅडव्हायजर) कायदेविषयक सल्लागार- या पेशातील व्यक्ती कॉर्पोरेट फम्र्सना त्यांची कायदेशीर कर्तव्ये, बांधीलकी, हक्क आणि इतर फम्र्सबरोबर असलेल्या कायदेशीर संबंधांबद्दल मार्गदर्शन करतात.

* (गव्हर्न्मेंट लॉयर) सरकारी वकील- हे वकील पोलीस खात्याशी समन्वय साधून सरकारसाठी काम करतात.

* (जज्ज) न्यायाधीश- खटल्यात समावेश असलेल्या सर्व व्यक्तींच्या बाजू ऐकून घेऊन खटल्याचा निकाल देणे, न्यायालयीन कारवाई करणे अशी निर्णायक जबाबदारी या व्यक्ती पार पाडतात.

                             "DIFFERENCE BETWEEN JUDGE AND MAGISTRATE"




JUDGE:-

Judge is a judicial officer appointed to hear and decide matters relating to law. 

The word 'Judge' has been derived from the Anglo French word 'JUGER' which means "TO FROM AN OPINION ABOUT".

From Old. French, the word 'JUGER' means 'TO JUDGE.'
From Latin 'JUDICARE' which also means "to judge, to examine officially; form an opinion upon; pronounce judgement."

Magistrate is a Civil Officer that has power to administer and enforce the law. He has limited judicial authority.

The word 'magistrate' has been derived from the Old. French word 'MAGISTRATE', which means "CIVIL OFFICER IN CHARGE OF ADMINISTRATING LAWS." 'MAGISTRATES', which also means "A MAGISTRATE, A PUBLIC FUNCTIONARY."



Judge and Magistrate are two terms that are often confused us to mean, it is generally believed that both the terms Judge and Magistrate refer to one and the same person. Actually, both of them differ in more than one aspect. A Judge is bestowed with more powers than a magistrate. A magistrate has only administrative and limited law enforcement powers. The power exercised by a magistrate are more than an administrative official. Magistrates may preside over lower level criminal cases and some civil matters. They may handle cases, such as, petty theft and small crimes etc. On the other hand, judges handle large cases.

Eg. District Collector/ District Magistrate is the administrative head of the district who is member of the Indian Administrative Service, and is appointed by the Government. He performs the statutory functions as required under various Legislations relating to the Revenue Administration such as revenue collection, taxation and the handling of natural and man-made emergencies etc. As a district magistrate he is responsible for maintenance of law and order, hearing cases under the preventive section of the Criminal Procedure Code, supervision of the police and jails etc. He is also responsible to maintain peace and justice in the district.

The District Judge is the head of the entire Judgeship and all other judicial offices in that district are under his subordination. The Court of District Judge is also appellate Court, which exercises jurisdiction both on original side and appellate side in civil and criminal matters arising in the district.

In Surendra Kumar Bhatia Vs. Kanhiya Lal & Ors. [2009 INSC 194 (30 January 2009)], Supreme Court has held that a district collector is not a Judge and as such cannot seek immunity from prosecution in criminal cases. The Court ruled that the immunity granted to Judges under section 77 IPC would not be available to district collectors or the land acquisition officers who acquire pvt. lands and award compensation.

"The collector is neither a judge as defined under section 19 nor does he act judicially, when discharging any of the functions under the (Land Acquisition) Act. Therefore, he is not entitled to protection under Section 77 of IPC."

"In making an award or making a reference or serving a notice, the collector neither acts in judicial nor in quasi judicial capacity but purely in an administrative capacity, exercising statutory powers as an agent and representative of the Government/ Acquiring Authority," the court observed. 

Magistrate classified into four categories according to the provisions of the Criminal Procedure Code, 1973 

    * A Chief Judicial Magistrate 

    * Judicial Magistrate First Class

    * Judicial Magistrate Second Class; and 

    * Executive Magistrates 

Chief Judicial Magistrate : Section 12 of the Criminal Procedure Code, 1973 Explains about the following terms,its runs as follows:

A. Chief Judicial Magistrate and Additional Chief Judicial Magistrate at First Class etc.

      1. In Every district (not being a metropolitan area), the High Court shall appoint a Judicial                       Magistrate of the First Class to be the Chief judicial Magistrate.

      2. The High Court may appoint any Judicial Magistrate of the First Class to be an Additional
          Chief Judicial Magistrate, and such Magistrate shall have all or any of the powers of Chief
          Judicial Magistrate under this code or under any other law for the time being in force as the
          High Court may direct.

      3. (a). The High Court may designate any Judicial Magistrate of the first class in any sub-division
                 as the Sub-Divisional Judicial Magistrate and relieve him of the responsibilities specified
                 in this section as occasion requires.      

          (b). Subject to the general control of the Chief Judicial Magistrate, every sub divisional judicial                  magistrate shall also have and exercise such powers of supervision and control over the
                 work of the Judicial Magistrate (other than additional Chief Judicial Magistrates ) in the
                 sub division as the high court may, by general or special order, specify in this behalf.

According to the Section 29 (1)  of the Code of Criminal Procedure, 1973 The Court of Chief Judicial Magistrate may pass any sentence authorized by law except a sentence of death or of imprisonment for life or of imprisonment for a term exceeding seven years.

Section 11 in The Code Of Criminal Procedure, 1973 explains about the following terms, it runs as follows:

11. Courts of Judicial Magistrates:-

(1) In every district (not being a metropolitan area), there shall be established as many Courts of   Judicial Magistrates of the First Class and of the Second Class, and at such places, as the state 
Government may, after consultation with the high Court, by notification, specify: 1[ Provided that the State Government may, after consultation with the High Court establish for any local 
area, one or more special courts of Judicial Magistrates of the First Class or of the Second Class   
to try any particular case or particular class of Cases, and where any such special court  
established, no other court of Magistrate in the local area shall have jurisdiction to try any case or class of cases for the trial of which such Special Court of Judicial Magistrate has been established.

(2) The Presiding officers of such courts shall be appointed by the High Court.

(3) The High Court may, whenever it appears to it to be expedient or necessary, confer the powers of a Judicial Magistrate of the first class or of the second class on any member of the Judicial Service of the State, functioning as a Judge in a Civil Court.

According to Section 29 (2) of the Code Of Criminal Procedure, 1973 The Court of a Magistrate of the first class may pass a sentence of imprisonment for a term not exceeding three years, or of fine not exceeding five thousand rupees, or of both.

Sec 29 (3) The Court of a Magistrate of the second class may pass a sentence of imprisonment for a term not exceeding one year, or of fine not exceeding one thousand rupees, or of both.
Executive Magistrates: Section 20 in The Code Of Criminal Procedure, 1973 explains about Executive Magistrate, it runs as follows

20. Executive Magistrates.

(1) In every district and in every metropolitan area, the State Government may appoint as many persons as it thinks fit to be Executive Magistrates and shall appoint one of them to be the District Magistrate.

(2) The State Government may appoint any Executive Magistrate to be an Additional District Magistrate, and such Magistrate shall have 1[ such] of the powers of a District Magistrate under this Code or under any other law for the time being in force 2[ as may be directed by the State Government].

(3) Whenever, in consequence of the office of a District Magistrate becoming vacant, any officer succeeds temporarily to the executive administration of the district, such officer shall, pending the orders of he State Government, exercise all the powers and perform all the duties respectively conferred and imposed by this Code on the District Magistrate.

(4) The State Government may place an Executive Magistrate in charge of a sub- division and may relieve him of the charge as occasion requires; and the Magistrate so placed in charge of a sub- division shall be called the Sub- divisional Magistrate.

(5) Nothing in this section shall preclude the State Government from conferring, under any law for the time being in force, on a Commissioner of Police, all or any of the powers of an Executive Magistrate in relation to a metropolitan area.
  
These Magistrates are normally conferred on the officers of the Revenue Department, although an officer can be appointed exclusively as an executive magistrate. Normally the collector of the District is appointed as the District Magistrate. Similarly, the Sub- Collectors are appointed as the Sub Divisional Magistrates. Tahsildars and Deputy/ Additional Tahsildars are appointed as Executive Magistrates.

The only difference between Judicial Magistrate and Executive Magistrate is that all cases can handle by the Judicial Magistrate whereas certain issued relating to public peace, maintenance of law and order etc etc can be handled by the Executive Magistrate.

स्त्रियांचे मानवी हक्क आणि मानव प्रतिष्ठा शाबूत ठेवणारे आणि समता आणि सामाजिक न्याय प्रस्थापित करणारे कायदे हवेत. आज महिलांसंबंधीच्या सर्वच कायद्यांची या आधारावर समीक्षा झाली पाहिजे. विशेषत: सर्व कुटुंबिक कायदे या दृष्टीने बघितले गेले पाहिजेत. 



              मुस्लिम व्यक्तिगत कायद्याचा प्रश्न पुन्हा ऐरणीवर आला आहे. देशभरात त्यावर उलट सुलट चर्चा सुरु आहे. या कायद्यात बदल केला जावा कि नाही याबाबत विविध मतप्रवाह समोर येत आहेत. त्यातला एक म्हणजे या कायद्यातील महिलांच्या विरोधात जाणाऱ्या तरतुदी बघता मुस्लिम महिलांनीच न्यायालयात धाव घेऊन या कायद्याला आव्हान दिले आहे. जुबानी तलाक, हलाल, बहुपत्नीत्व या विरोधात या महिला बोलत आहेत. या कायद्यात बदल झाला पाहिजे, असे त्यांचे म्हणणे आहे. 


            या बाबत दुसरा मतप्रवाह आहे तो ऑल इंडिया मुस्लिम पर्सनल लॉ बोर्डाचा. त्यांचे म्हणणे आहे की हा कायदा दैवी आहे, त्यामुळे त्यात बदल होऊ शकत नाही. शिवाय हा कायदा धर्माधारित आहे त्यामुळे यात सरकारने ढवळाढवळ करू नये. 

              तिसरा मतप्रवाह आहे तो म्हणजे कायदा रद्द करून सामान नागरी कायदा झाला पाहिजे. जो सामान गरी कायद्याला विरोध करेल तो देशद्रोही. शिवाय बहुपत्नीत्वाची मान्यता या कायद्यात असल्याने 'वो पांच उनके पच्चीस' होणार त्यामुळे मुस्लिम पुरुषाला बहुपत्नीत्वाचा हक्क नसला पाहिजे, असे म्हणणारा प्रवाह. 

       चौथा मत प्रवाह आहे तो म्हणजे इस्लामिक कायद्याचे संहितीकरण झाले पाहिजे. (कोडिफिकेशन ऑफ मुस्लिम लॉ)  या मतप्रवाहात भारतीय भारतीय मुस्लिम महिला आंदोलन येते. त्यांचे म्हणणे आहे की, मुस्लिमांसाठी धर्माधारीतच कायदे असले पाहिजेत आणि धर्माची योग्य ती परिभाषा करून इस्लामी कायद्याचे संहितीकरण केले पाहिजे. 


      पाचवा मतप्रवाह आहे तो म्हणजे स्त्रियांना मानवी हक्क आणि न्याय देणारे कायदे हवेत. वैश्विक मानवी मुल्ये आणि मानवी हक्क यावर ते आधारलेले असले पाहिजेत. जेंडर जस्ट लॉज अशी त्यांची मागणी आहे. या सर्वांचा विस्ताराने परामर्श घेण्याची गरज आहे. 


        यातील पहिला प्रवाह आहे तो न्यायालयात धाव घेतलेल्या पीडित महिलांचा आहे. त्यांची वेदना समजून घेतली पाहिजे. त्याऐवजी आमचे धार्मिक कायदे बरोबरच आहेत, चूक माणसांची आहे, असे म्हणून धर्ममार्तंड त्यांच्या दुःखाची टर उडवतात. पण समाजात अश्या घटना घडत आहेत वास्तव आहे. धर्मग्रंथ काय म्हणतात या चर्चानी त्यांच्या दुःखावर फुंकर घालता येणार नाही. त्यामुळे पीडित महिलांच्या म्हणण्याचा सहानुभूतीपूर्वक आणि गंभीरपणे विचार झालाच पाहिजे. 


      दुसरा प्रवाह आहे तो ऑल इंडिया मुस्लिम पर्सनल लॉ बॉर्डाचा हा कायदा दैवी आहे, धर्मांधारित आहे, त्यात बदल होऊ शकत नाही, सरकारने यात ढवळाढवळ करू नये, हा  आमच्या अस्मितेचा प्रश्न आहे. हा भारतातील धार्मिक विविधतेवर घाला आहे ईत्यादी. यातील एकही बाब तर्काच्या आधारावर टिकणारी नाही. एकतर हा कायदा १९३७ मध्ये ब्रिटिशांनी आणला. त्या आधी मुस्लिम समाजात रूढी- परंपरा, प्रांतीय रूढी-परंपरा या आधारावर कायदे कानून होते. मुस्लिम समाज हा मोनोलिथिक कधीच नव्हता. वेगवेगळ्या जाती, जमाती, पंथ, प्रांतीय विविधता त्यांच्यात आहे. ब्रिटिशांनी शरियत ऍक्ट १९३७ आणून सर्व मुसलमान समूहांची एक धार्मिक ओळख निर्माण केली. ज्या ब्रिटिशांच्या विरोधात १८५७ मध्ये मुसलमान धर्मगुरू लढले त्या ब्रिटिशांनीच केलेला कायदा दैवी कसा झाला. या कायद्यात बदल होऊ शकत नाही असे हे धर्ममार्तंड म्हंणतात पण ब्रिटिशांनीच शरियतचा गुन्हेगारी कायद्याचा भाग  वगळून फक्त कौटुंबिक कायदा ठेवला, शिवाय १९३९ मध्ये विवाहविच्छेद कायदा आणून न्यायालयात जाऊन तलाक मागण्याची मुभा मुस्लिम स्त्रीला दिली, स्वातंत्र्योत्तर भारतात भारत सरकारने विशेष विवाह कायदा १९५४ आणला ज्या अंतर्गत धार्मिक कायदे लागू होत नाहीत.  याशिवाय स्वतः मुस्लिम पर्सनल लॉ बॉर्डानेच शाहबानो प्रकरणाच्या वेळी उलट बदल घडवण्यासाठी रान पेटवून पोटगी हक्क कायद्यातून मुस्लिम स्त्रीला वागळण्यासाठी दबाव आणला आणि तत्कालीन राजीव गांधी सरकारने त्यासाठी घटना बदल करून कायदा आमलात आणला शिवाय न्यायालयांचे मुस्लिम महिलांच्या न्यायाच्या प्रश्नावर दिलेले वेगवेगळे निकाल आहेतच. त्यामुळे बदल होऊ शकत नाही, यात तथ्य नाही. राहिले धार्मिक ओळखीचा प्रश्न तर मुस्लिम समुदाय मोनोलिथिक नाही हे वास्तव आहे. शिया, सुन्नी, वहाबी, अहमदिया इ. पंथ तर खोजा, मेमन, मोपला, कच्छी ते  विविध जाती समूह मुस्लिम समाजात आहेत. त्यामुळेच शिया  धर्मगुरुंनी जुबानी तलाकची प्रथा कायद्याने रद्द करायला आमची हरकत नाही असे जाहीर केले कारण आताच्या मुस्लिम व्यक्तिगत कायद्यावर हनाफी पंथाचा  आहे. शिवाय मुस्लिम अस्मिता, मुस्लिम ओळख नष्ट होईल, या म्हणण्याला उत्तर गोवा प्रांताचे आहे. तिथे एकाच कायदा लागू असून तो जेंडर जस्टीस करणारा आहे का, यावर चर्चा होऊ  शकते परंतु एक कायदा असूनही  तिथल्या हिंदू, मुसलमान, ख्रिश्चन, यांची धार्मिक ओळख पुसली गेली आहे, असे नाही. 


      मात्र व्यतिगत कायद्यात बदल करून समान नागरी कायदा आणला पाहिजे अस्से म्हणणे असणाऱ्या हिंदुत्ववादी संघटनांनी मुस्लिम स्त्रियांच्या न्यायाचा प्रश्न हा मुस्लिम समाजाच्या विरोधात वापरण्याचे हत्यार बनवला शिवाय मुस्लिम स्त्रीच्या न्यायाचा प्रश्न राष्ट्रदोहाशी जोडला जणू त्यांनी हिंदू कोड बिलाला विरोध केलाच नव्हता. मात्र या सगळ्या प्रकाराने अल्पसंख्यक समुदायामध्ये भय आणि चिंतेचे वातावरण निर्माण होते. शिवाय सामान कायदा म्हणजे हिंदूंचा कायदा लागणार असे वाटू लागते इ . यात भर पडते ती अल्पसंख्यांक समूहांवर केल्या जाणाऱ्या हल्ल्यांची. त्यामुळे समाजाचे कलापिकारां होत जाते आणि पुन्हा धर्मांध शक्ती त्यांचा ताबा घेतात. या मतप्रवाहाला खरोखर बदल हवाच असतो, असे नाही अन्यथा हिंदुत्ववादाचा झेंडा घेतलेल्या भारतीय जनता पक्षाने सत्ता असलेल्या आपापल्या राज्यात याबाबत पुढाकार घेतल्याचे दिसले असते. शिवाय कॉमन सिव्हिल कोड आणि युनिफॉर्म सिव्हिल कोड यात फरक आहे ते स्पष्ट केले पाहिजे. भारताचे संविधान युनिफॉर्म सिव्हिल कोड शब्द वापरते. एकाच कायदा नाही तर सर्वांसाठी एकरूप नागरी संहिता ज्यात सांस्कृतिक विविधता शाबूत राहील आणि न्यायाचे तत्व सर्वांना सामान लागू होईल. 



      संविधानातील एकरूप नागरी संहितेच्या मार्गदर्शक तत्व सत्तेवर असलेल्या कोणत्याही सरकारने आणि कोणत्याही राजकीय पक्षाने गंभीरतेने घेतले नाही. आताच्या केंद्र सरकारच्या विधी आयोगाने तर युनिफॉर्म सिव्हिल कोडसाठी थेट जनतेलाच प्रश्नपत्र पाठवले आहे. पुरुषप्रधान समाजामध्ये स्त्रीला न्याय देणारे कायदे बनवण्यास लोकमत अनुकूल असते काय ? आणि कायदे लोकमतावर बनवले जातात काय ? जातिगत विषमता असलेल्या समाजात अस्पृश्यताविरोधी कायदा करताना असे लोकमत घेतले असते तर ? मुस्लिम स्त्रियांच्या न्यायाचा प्रश्न एकदम युनिफॉर्म सिव्हिल कोडवर कसा गेला, हाही प्रश्न उपस्थित होतोच. आणि युनिफॉर्म सिव्हिल कोडवर गेला तरी सरकारने त्याचा मसुदा तयार करून त्यावर चर्चा घडवून आणली पाहिजे हा मार्ग असू शकतो. इस्लामिक कायद्याचे साहित्यिकरण झाले पाहिजे असे म्हणणाऱ्या भारतीय मुस्लिम आंदोलनाने शरियत कोर्ट चालवली, महिला काझी प्रशिक्षित केल्या तरीही मुस्लिम महिला न्यायालयात धाव घेत आहेत, ही वस्तुस्तिथी आहे. शिवाय इस्लामिक कायद्यांच्या संहितीकरणात जो धोका आहे तो म्हणजे पुन्हा हा कायदा धर्ममार्तंडांचे हत्यार बनेल आणि तेच राजकारण पुन्हा सूरु होईल. शिवाय इस्लामच्या परिभाषेबाबत इतके भिन्न विचारप्रवाह आहेत की सर्वांचे एकमत होणे कठीण आहे. त्यावर पुरोगामी परिभाषा सांगणाऱ्या मतप्रवाहाचेच संहितीकरण होईल याची खात्री काय ? मुस्लिम महिलांनी याची वाट किती काळ बघावी आणि न्यापासून वंचित राहावे?



      यातला जो पाचवा प्रवाह आहे तो या सर्व धार्मिक राजकारणाच्या पलीकडे जाऊन सर्वच स्त्रियांना न्याय देणाऱ्या जेंडर जस्ट लॉची मागणी करतो. १९७५ नंतरच्या स्त्री चळवळीतून ही मागणी पुढे आली आहे.  आज अनेक मुस्लिम महिला चळवळींची ही ती मागणी आहे. यात बेबाक कलेक्टिव्ह नावाचे आठ प्रांतांमधील मुस्लिम महिला संघटनांचे एक नेटवर्क आहे त्यांची तसेच डाव्या महिला संघटनांचाही हाच दृष्टिकोन आहे. या दृष्टिकोनानुसार स्त्रियांचे मानवी हक्क आणि मानव प्रतिष्ठा शाबूत ठेवणारे आणि समता आणि सामाजिक न्याय प्रस्थापित करणारे कायदे हवेत. आज महिलांसंबंधीच्या सर्वच कायद्यांची या आधारावर समीक्षा झाली पाहिजे. विशेषतः सर्व कुटुंबिक कायदे या  दृष्टीने बघितले गेले पाहिजेत. भारतातल्या सर्वच स्त्रियांसाठी ते उपकारक ठरेल.
